Why you should fight

10/01/2011 - By Doug Dern

If you have just been arrested for drunk driving you might be asking yourself why you should fight. I mean its just a first offense. You had a friend that got arrested for OWI and he didn't have an attorney and they pleaded down to an impaired driving and nothing happened to him. He did ok with out a lawyer. So why should you fight? I will give you 3 good reason.

1. You are not a criminal. Many times the person arrested for an OWI in Michigan didn't even know they were breaking the law. They were at a business dinner and had a couple of drinks and due to some over zealous police work you find yourself in jail. You might actually be innocent. I believe the police are so hell bent on stopping drunk drivers that they tend to error on the side of safe then sorry. So here you are a non criminal and the result of a mistake by the cops. Ok, well maybe you can live with an impaired driving and the fines and cost that go with it.

2. Felony DUI. a third drunk driving conviction in a lifetime in Michigan is a felony. According MADD over 2 million people are arrested every year for third offese DUI's. Think about that. What if you are borderline or innocent but you plead to a first offense cause its no big deal. So you are a young person. A lifetime. As stupid as this law is it is still a law if you get one DUI there is a strong chance that you might get another one actually a 21% chance.

3. Plain and simple if you get a second OWI in Michigan you will lose your drivers license. It is a total revocation.

Yes there are plenty ofo reasons to fight your drunk driving. The justice system is full of lawyers that tell you you can't fight a drunk driving case. The justice system is all about moving cases. Don't get caught in system.
